Re: Obligation to serve and other matters, Telecom Notice of Consultation CRTC 2010-43: Revised procedure
Dear Madam, Sir:
By letters dated 29 July and July 30 2010, Bragg Communications Inc (Bragg) and TELUS Communications Company (TCC), respectively, requested an extension to filing dates to allow them to respond to certain interrogatories filed pursuant to procedures established in Telecom Notice of Consultation 2010-43, as amended by Telecom Notice of Consultation 2010-43-2 (NoC 2010-43).
Bragg and TCC requested an extension from 3 August 2010 to 10 August 2010 to file responses to the interrogatories issued on 20 July 2010.
Bragg submitted that the key personnel necessary to provide full and complete responses to many of these interrogatories would be absent from the office. TCC stated that it faced similar circumstances.
After careful consideration, Commission staff considers it appropriate to modify the procedures set out in NoC 2010-43. The changes to the dates are set out below:
- Responses to interrogatories addressed pursuant to paragraph 41 are to be filed with the Commission and served on all parties by 6 August 2010.
- Requests by parties for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out in each case the reasons for disclosure, must be filed with the Commission and served on the relevant party or parties by 13 August 2010.
- Written responses to requests for further responses to interrogatories and for public disclosure must be filed with the Commission and served on the party or parties making the request by 20 August 2010.
- A determination will be issued with respect to requests for further information and public disclosure as soon as possible. Any information to be provided pursuant to that determination will be filed with the Commission and served on all interested parties by 3 September 2010.
