Re: TELUS Communications Company and MTS Allstream Inc. applications regarding alleged overbilling by TBayTel for Competitor Digital Network Services

On 22 June 2010 TELUS Communication Company (TCC) filed a Part VII application requesting that the Commission direct TBayTel to refund to TCC previously overbilled charges for its Competitor Digital Network (CDN) Access Services.

On 16 July 2010, MTS Allstream Inc. (MTS Allstream) filed a Part VII application requesting that the Commission direct TBayTel to refund to MTS Allstream previously overbilled charges for its CDN Access Services, and direct TBayTel to identify its CDN serving wire centres so that any overbilling resulting from inter-office channels can also be refunded.  MTS Allstream also requested that its application be enjoined with TCC’s application, and that the due dates for comments and reply comments for both applications be consistent with those for MTS Allstream’s application.

Commission staff notes that the relief requested by MTS Allstream is not identical to that requested by TCC.  Accordingly, Commission staff considers it appropriate to maintain the standard deadlines for the filing of comments in relation to TCC’s application.  This will allow the Commission to consider both applications in the manner it considers most expedient.
