Re: Call for comments on the customer transfer process and related competitive issues, Broadcasting and Telecom Notice of Consultation 2010-406, 23 June 2010, as amended by Broadcasting and Telecom Notice of Consultation 2010-406-1, 5 July 2010 (NoC 2010-406)
This letter is in response to (a) a request by the Canadian Independent Telephone Company Joint Task Force (the JTF), dated 7 July 2010, for an extension to filing dates in the NoC 2010-406 proceeding, and (b) a request by Rogers Communications Inc. (Rogers), dated 30 June 2010, for an amendment to NoC 2010-406 to include the handling of wireless customer cancellation and transfer requests.
Commission staff notes that NoC 2010-406 included a request by Shaw Communications Inc. (Shaw) for a Commission determination regarding the handling of customer cancellations and transfers among broadcasting distribution undertakings.
Commission staff considers that broadening the scope of the proceeding to examine issues related to wireless customer cancellations and transfers would introduce an unacceptable amount of complexity and delay in the Commission’s determination on the matters raised in this proceeding. An expeditious resolution by the Commission, particularly as it relates to Shaw’s specific application before the Commission, is required in light of the significant effects on competition and consumer choice. In light of this, an examination of the issues related to customer cancellation and transfers for wireless services will not be dealt with at this time. Commission staff also denies JTF’s request for an extension as approval of this request would introduce an unacceptable delay in the above noted proceeding.
