Re: Bell Aliant Tariff Notice 331 and Bell Canada Tariff Notice 7270
On 8 July 2010, Bell Aliant Regional Communications, Limited Partnership and Bell Canada (collectively, the Bell companies) filed Tariff Notices 331 and 7270, respectively, to amend their tariff pages for Wholesale Local Service and Features (WLSF). The amended pages contained clarifications and proposed changes to specify the conditions under which a WLSF service charge was applicable and when a WLSF one-time credit would be provided.
In addition, the Bell companies also requested that the existing $50 credit from section 4(d) of Item 317 of the Access Services Tariff (WLSF tariff) be made interim on an expedited basis.
Staff notes that on 8 July 2010, the Bell companies filed a review and vary (R&V) application of Telecom Decision 2010-323, which, among other matters, also raised the request to make the above-noted $50 credit rate element from the existing WLSF tariff interim.
In light of the R&V application, Commission staff considers the filing of Bell Aliant Tariff Notice 331 and Bell Canada Tariff Notice 7270 to have been premature, and is therefore returning these applications. Staff notes that the request to make the above-noted $50 credit interim will be considered as part of the R&V application, and also notes that the Bell companies have the option of re-filing tariff applications once the Commission has made its determinations on the R&V application, if the Bell companies so desire. Accordingly, the files for Bell Aliant Tariff Notice 331 and Bell Canada Tariff Notice 7270 will now be closed.
