Re: Obligation to serve and other matters, Telecom Notice of Consultation CRTC 2010-43: Revised procedure
By letter dated 1 June 2010, the Ontario Telecommunications Association (OTA) and TBayTel requested an extension to respond to certain interrogatories which were filed pursuant to procedures established in Telecom Notice of Consultation CRTC 2010-43, as amended by Telecom Notices of Consultation CRTC 2010-43-1 and 2010-43-2 (NoC 2010-43).
The OTA and TBayTel requested an extension from 15 June 2010 to 29 June 2010 to file responses to the following interrogatories:
• CRTC 101, 102, 103;
• Bell Aliant 2;
• Bell Canada 1, 2, 3;
• Cable Companies 4; and
• TELUS:
- Attachment O questions 1, 3, 4, 5
- Attachment R questions 1, 3, 4.
In its letter, the OTA and TBayTel submitted that the above interrogatories requested very detailed information. The OTA and TBayTel submitted that, due to resource constraints, an extension was necessary to allow the small incumbent local exchange carriers sufficient time to gather and aggregate the information requested.
By letter dated 2 June 2010, the Association des Compagnies de Téléphone du Québec (ACTQ) supported this request. These interrogatories were also posed to the ACTQ member companies.
After careful consideration, Commission staff considers it appropriate to modify the procedures set out in NoC 2010-43 with respect to the interrogatories identified above. The changes to the dates are set out below:
- Responses to the above-identified interrogatories are to be filed with the Commission and served on all parties by 25 June 2010;
- Requests by parties for further responses to the above-indentified interrogatories, specifying in each case why a further response is both relevant and necessary, as well as requests for public disclosure of information provided in response to the above-identified interrogatories and for which confidentiality has been claimed, setting out in each case the reasons for disclosure, must be filed with the Commission and served on the relevant party or parties by 30 June 2010; and
- Written responses to requests for further responses to the above-identified interrogatories and for public disclosure must be filed with the Commission and served on the party or parties making the request by 6 July 2010.
