Re:   Extension requests - proceeding initiated by Telecom Notice of Consultation CRTC 2009-432, 21 July 2009

Dear Madams, Sirs:

In a letter dated 17 May 2010, TELUS Communications Company (TELUS) indicated that it will not be able to complete its responses to interrogatories which are required by 19 May 2010 and requested that the filing date for these interrogatory responses be extended to 28 May 2010.

In a letter dated 18 May 2010, Bell Aliant Regional Communications, Limited Partnership, Bell Canada and Télébec, Société en commandite (collectively, the Bell companies) supported TELUS’ request and in the interest of procedural fairness, proposed that the requested extension apply to all parties.

In a letter dated 19 May 2010, Bragg Communications Inc., the Canadian Cable Systems Alliance, Cogeco Cable Inc., Rogers Communications Inc., Shaw Communications Inc. and Quebecor Media Inc., on behalf of its affiliate Vidéotron Ltd. (collectively, the Cable Carriers) submitted that if TELUS’ extension is granted, the Cable Carriers would require a further one-week extension in the date for the filing of requests for further responses and disclosure, to 11 June 2010.  The Cable Carriers explained that since TELUS is proposing to file its interrogatory responses on the Friday before the commencement of the oral phase of the proceeding initiated by Telecom Notice of Consultation CRTC 2009-261, Proceeding to consider the appropriateness of mandating certain high-speed wholesale access services, they would no longer be able to file their requests for further responses and disclosure within seven days of receipt of the interrogatory responses.  

The Cable Carriers further submitted that the TELUS extension, if granted, would result in significant additional delay and that the Commission should take that into consideration when it ultimately determines the date for implementation of any revised rates.

By letter dated 20 May 2010, TELUS replied that it was also concerned with the length of this proceeding.  TELUS submitted however, that with the volume of interrogatories received on

28 April 2010, including 56 detailed interrogatories from the Cable Carriers, it was not able to complete its responses to interrogatories received from the Commission and parties by 19 May 2010. 

Commission staff notes the large number and complexity of the interrogatories posed and considers that an extension to 28 May 2010 for the filing of ILEC interrogatory responses is appropriate.

Commission staff also considers that an extension to 11 June 2010 for the filing of requests for further responses to interrogatories and requests for public disclosure of information for which confidentiality has been claimed is appropriate.  Accordingly, the process and deadlines set out in the Commission staff’s 9 April 2010 letter are revised as follows:
