Re: TELUS Communications Company – application to review and vary Telecom Decisions CRTC 2009-85 and 2010-11

By letter dated 12 April 2010, TELUS Communications Company (TCC) filed an application pursuant to Section 62 of the Telecommunications Act and Part VII of the CRTC Telecommunications Rules of Procedure.  In its application, TCC requested that the Commission review and vary Public Works and Government Services Canada – Application for a Commission determination regarding telecommunications services provided by Bell Canada, Telecom Decision CRTC 2009-85, 20 February 2009 (Telecom Decision 2009-85), and TELUS Communications Company – Application to review and vary portions of Telecom Decision 2009-85 regarding telecommunications services provided by Bell Canada to PWGSC, Telecom Decision CRTC 2010-11, 14 January 2010 (Telecom Decision 2010-11).

In support of its application, TCC alleges that the Commission failed to consider a basic principle that was raised in the proceeding leading to Telecom Decision 2009-85, namely, the impact of the Commission’s decision on competition relating to transitions to new suppliers in complex telecommunications markets where agreement cannot be reached with the incumbent.

By letter dated 27 April 2010, Bell Canada requested that the Commission find TCC’s application to be an abuse of process and, therefore, summarily dismiss the application. Bell Canada submitted that no new relevant facts or arguments were raised by TCC on the issues that should cause the Commission to question its earlier determinations.  Bell Canada also requested that, if the Application were not dismissed, Bell Canada be given additional time to file a reply to TCC’s application. 

Commission staff considers that its normal Part VII process is appropriate in the circumstances.  As such, Bell Canada will have the opportunity to submit arguments on the issues raised in TCC’s application.

Accordingly, Bell Canada may submit comments with regard to TELUS’ application by 28 May 2010.  TCC may file its reply by 7 June 2010.
