Re:  Follow-up to Use of deferral accounts to improve access to telecommunications services for persons with disabilities and to expand broadband services to rural and remote communities, Telecom Decision CRTC 2008-1 (Telecom Decision 2008-1)

The Commission is in receipt of correspondence from MTS Allstream Inc. (MTS Allstream), dated 30 April 2010, requesting that the Commission direct TELUS Communications Company (TCC) to file its tariff for its competitor services with the associated cost study by 14 May 2010 and provide parties the opportunity to comment by 21 May 2010.

Commission staff notes that no tariff notice is expected to be filed by TCC at this time, since the company has proposed to use agreements instead of tariffs for its proposed competitor services.  However, the Commission expects to receive TCC’s regulatory economic cost study for its proposed competitor services, with the detailed costs submitted in confidence, by 7 May 2010.[1]

Commission staff considers that the absence of the abridged version of the regulatory economic cost study should not deter most interested parties from filing comments pursuant to the current schedule.  The current deadlines for these submissions are 7 May 2010 for comments and 14 May 2010 for reply comments.  In light of this, an extension of the current deadlines for the purpose of allowing public comment on the cost study is not required.

However, should MTS Allstream or other parties wish to file additional comments with respect only to the TCC regulatory economic cost study, they may do so one week after the interrogatory response including the study is filed with the Commission.  Further, parties may file reply comments with respect to these additional comments one week after these comments are filed.

Submissions and comments are to be filed with the Commission, serving copies on all other parties to the proceeding, including parties listed in the attached distribution list.  Submissions must be received, not merely sent, by the dates noted above.
