Re: Request to modify the schedule of Telecom Notice of Consultation CRTC 2010-43 – Obligation to serve and other matters (NoC 2010-43)

The Commission is in receipt of a letter dated 12 March 2010 from the Public Interest Advocacy Group (PIAC) on behalf of the Consumer Groups requesting that the schedule of NoC 2010-43 be modified. Specifically, PIAC requested an extension of the filing of initial evidence and comments from 12 April 2010 to 26 April 2010. PIAC proposed that no other modifications to the schedule be made.

 

While most parties that commented on PIAC’s request were in agreement, TELUS Communications Company (TELUS) and TekSavvy Solutions Inc. (TSI), by letters dated 15 and 16 March 2010 respectively, objected to the proposal that no other modifications be made to the schedule. Should the Commission see fit to grant PIAC’s request, TELUS and TSI submitted that all subsequent deadlines in this proceeding be pushed back by two weeks, the length of the extension requested by PIAC.

In addition, by letter dated 15 March 2010, the Canadian Internet Policy and Public Interest Clinic (CIPPIC), on behalf of OpenMedia.ca, proposed that parties be given a second opportunity to provide evidence, by 15 June 2010, to respond to evidence from interrogatories with counter evidence.

After consideration of the submissions received, Commission staff considers the schedule of NoC 2010-43 should be modified. The filing date for initial evidence and comments will be extended to 26 April 2010 and all subsequent filing deadlines will be pushed back by two weeks. There will be no change to the oral hearing schedule.

 

With respect to CIPPIC’s proposal, Commission staff considers that a second round of evidence is not required. Parties will have ample opportunity, based on the existing process, to participate meaningfully in the proceeding through the submission of evidence, participation in the oral hearing and filing of final argument. In addition, parties will have the opportunity to fully test other parties’ evidence through the interrogatory processes.

 

A revised notice of consultation will be issued shortly.
