Re: Update to Competitive Local Exchange Carrier General Tariff
Dear Madams, Sirs:
In Telecom Decision 97-8, the Commission considered that it was in the public interest to require competitive local exchange carriers (CLECs) to provide interconnection for wireless service providers and equal access for all interexchange service providers, at terms and conditions equivalent to those contained in the tariffs of the incumbent local exchange carriers (ILECs). The Commission required all CLECs to file proposed tariffs for interconnection and to justify any departure from the terms and conditions contained in the ILECs' tariffs.
In the event that a CLEC would not use the same rates as the ILEC in a particular territory and would prefer to use its own rates that have received past Commission approval, the rates used should be shown in the CLEC’s General Tariff, rather than the cross-references.
In the event that a CLEC would propose new rates that differ from its own approved rates or from the rates of the ILEC in a particular territory, then cost justification must be submitted with the proposed rates, along with supporting rationale for any departure from the ILECs’ rates, consistent with Telecom Decision 97-8.
In view of the recent changes to the ILECs’ tariffs, CLECs are required to update their General Tariff by 12 April 2010 to ensure their compliance with the Commission’s determinations set out in Telecom Decision 97-8. To assist CLECs with their required filings, it is noted that the changes described below can be found on the CRTC website as part of the CLEC Model Tariff version 32 at http://www.crtc.gc.ca/cisc/eng/cisf3g5.htm.
Description of updates to version 32 of the CLEC Model Tariff
In Telecom Order 2010-144, the Commission approved the amalgamation of TELUS Communications Company’s (TCC) tariffs related to the interconnection by Wireless Service Providers (WSPs) into TCC’s Carrier Access Tariff. Consequently, Commission staff has updated the CLEC Model Tariff to reflect the cross-references to the rates applicable to the interconnection services provided to WSPs in Alberta and British Columbia.
Commission staff notes that in Telecom Order 2010-144, the Commission determined that the CLEC Model Tariff should only have specified the references to the appropriate WSP link charges in each ILEC’s tariff. Consequently, page 56 of the CLEC Model Tariff has been updated to reflect the Commission’s determination in this regard.
Commission staff notes that in Telecom Decision 2009-400, the Commission directed CLECs who had not executed agreements for 9-1-1 Emergency Response Service (ERS) with all local authorities in the territories in which they operate to file for Commission approval tariff pages reflecting the 9-1-1 ERS model tariff set out in Appendix 1 to that decision. Consequently, Commission staff has updated the CLEC Model tariff to incorporate Item 503 – 9 1-1 ERS.
Commission staff also notes that in Telecom Regulatory Policy 2009-424, the Commission determined that it was appropriate to forbear from regulating late payment and non-sufficient funds (NSF) charges associated with tariffed services. However, the Commission imposed a condition on the rates for late payment and NSF charges associated with a LEC’s tariffed services such that these rates shall not exceed the lowest rate charged in association with any of its non-tariffed services. Consequently, Commission staff has updated the CLEC Model Tariff to reflect the Commission’s determinations set out in Telecom Regulatory Policy 2009-424.
Commission staff further notes that it made certain housekeeping changes when updating the CLEC Model Tariff. These housekeeping changes include the correction of the cross-reference to the rates applicable to Termination of LEC Intra-exchange Traffic in Prince Edward Island, the modification of the title of the CLEC Model Tariff, and page formatting. It should be noted that in the French version of the CLEC Model Tariff, the word [FILE] was revised in order to better reflect the intent of this note.
