Re:  Part VII application from Electronic Box Inc. to review Telecom Decision 2006-77 re third-party Internet access service rates

Dear Mr. Béïque:

On 19 October 2009, Electronic Box Inc. (Electronic Box) filed a Part VII application in which it requested that the Commission review certain aspects of Cogeco, Rogers, Shaw, and Videotron – Third-party Internet access service rates, Telecom Decision CRTC 2006-77, 21 December 2006.

As part of its 18 November 2009 response to this application,[1] Quebecor Media Inc., on behalf of its affiliate Videotron Ltd. (Videotron), filed Tariff Notice 27.  In this tariff notice, it was proposed that Videotron’s Extreme High-Speed (EHS) wholesale third-party Internet access (TPIA) monthly rate be reduced from $70.15 to $52.19.  On 23 December 2009, the Commission approved,[2] on an interim basis, the proposed monthly rate of $52.19 for EHS wholesale TPIA.

Commission staff notes that the other issues raised in Electronic Box’s application are associated with the terms and requirements of the TPIA wholesale service.  Commission staff further notes that the Commission is currently reviewing the appropriateness of mandating certain wholesale high-speed access services in the proceeding initiated by Telecom Notice of Consultation 2009-261,[3] and that the determination in that proceeding could be relevant to the terms and requirements for this wholesale service.  In the circumstances, Commission staff considers Electronic Box’s application to be closed.

If Electronic Box is not satisfied that its issues have been addressed by the Commission in its final determination in the proceeding initiated by Telecom Notice of Consultation 2009-261, Electronic Box can file a Part VII application at that time requesting that the Commission review any outstanding issues.
