Subject: Follow-up to Use of deferral accounts to improve access to telecommunications services for persons with disabilities and to expand broadband services to rural and remote communities, Telecom Decision CRTC 2008-1 (Telecom Decision 2008-1)


Dear Madams, Sirs:


In this letter, the Commission initiates a further process to address submissions made with respect to the remaining follow-up processes related to Telecom Decision 2008-1.


Submissions received from the incumbent local exchange carriers re: remaining
follow-up processes related to Telecom Decision 2008-1


In response to its letter on this subject, dated 25 September 2009 establishing the follow-up processes, the Commission has received submissions, dated 15 January 2010, from Bell Aliant Regional Communications, Limited Partnership and Bell Canada (collectively the Bell companies), MTS Allstream Inc. (MTS Allstream), including MTS Allstream’s Tariff Notice 687, and TELUS Communications Company (TCC).  These submissions address the proposed broadband expansion plans and proposed competitor services of these companies.

Further submissions are expected from these companies on 29 January 2010.  These submissions are to address the rebates to be made to residential customers in non- high-cost serving areas pursuant to the Commission’s direction in Telecom Decision 2008-1.  As well, the Bell companies will file, on 26 February 2010, detailed roll-out plans, revised cost studies, and deferral account drawdown estimates as well as tariffs for the proposed backbone access service.

With respect to the broadband expansion plans, by letters issued today, the Commission is addressing interrogatories to the Bell companies and TCC.  Responses to these interrogatories are to be submitted to the Commission and to all parties included on the distribution list attached to this letter by 18 February 2010.

Other submissisons

Prior to the establishment of this further process, the Commission received comments, dated 20 January 2010, from Axia SuperNet Ltd. (Axia) related to the submission of TCC referenced above.  These comments will be placed on the public file and form part of this process.

Further, Globalive Wireless Management Corp. (Globalive) filed a Part VII application, dated 21 January 2010, with respect to the Bell companies’ submission.  The Commission notes that Globalive’s application addresses issues that will be disposed of within this proceeding.  Accordingly, the Commission will not consider Globalive’s application under Part VII of the CRTC Telecommunications Rules of Procedure, but as comments related to the Bell companies’ submissions in this proceeding.


Parties may file comments with respect to the 15 and 29 January 2010 submissions of the Bell companies, MTS Allstream, and TCC, Axia’s and Globalive’s comments, the responses to the Commission’s interrogatories, and the 26 February 2010 submission of the Bell companies.  These comments are to be filed with the Commission, serving copies on all other parties, by 12 March 2010.  Reply comments may be filed with the Commission, serving copies on all other parties, by 22 March 2010.
