Re: Part VI Application for Clarification of Paragraph 48 of Telecom Decision CRTC 2007-10

On 15 January 2010, the Commission received the above-mentioned Part VI application by MTS Allstream Inc. (MTS Allstream), pursuant to the CRTC Telecommunications Rules of Procedure, seeking clarification of paragraph 48 of Telecom Decision CRTC 2007-10.   More specifically, MTS Allstream requested confirmation that the phrase “applicable limitation periods provided by law” in Article 120.1 of TELUS Communications Company’s (TCC) Terms of Service is, in the case of the overbilled Basic Service Extension Feature (BSEF) charges in the Province of Alberta, a reference to the Alberta Limitations Act.

Commission staff is of the view that the issue raised by MTS Allstream’s application is relevant to other local exchange carriers and their customers.  Accordingly, MTS Allstream’s above mentioned application will be treated as a Part VII application.  MTS Allstream’s application is available on the Commission website at www.crtc.gc.ca under “Public Proceeding” or by using the file number provided above.

All parties may file comments on MTS Allstream’s application by 26 February 2010, serving copies to the interested parties to Telecom Decision CRTC 2007-10.  MTS Allstream may file reply comments, serving copies on other parties who filed comments on its application, by 8 March 2010.

Where a document is to be filed by a specific date, the document must be actually received, and not merely sent, by that date.
