Dear Ms. Courtemanche:

Re: Re-branding of Canadian Learning Television (CLT) as Viva

As a follow-up to our letter of 24 November 2008, please provide information to demonstrate that Viva is still operating in accordance with its nature of service.

Canadian Learning Television’s nature of service and conditions of licence (Decision CRTC 2004-17) stipulate that CLT (now Viva) is an educational service that provides a predominance (not less than 55%) of formal educational programming with clear learning objectives.

In particular, we would like an explanation as to how the significant presence of Category 7 (Drama and comedy) fits with the educational aspect of your nature of service.

Please be advised that this letter and all related correspondence will be placed on the public file (case #419161).

Yours sincerely,

(original signed by)

Scott Hutton,
Executive Director
