Application by Glassbox Television Inc. (Glassbox) to amend the broadcasting licence of the Category 2 specialty programming undertaking known as BITE Television (BITE). The licensee proposes to change its nature of service condition of licence in order to permit BITE to draw programming from category 7(b) On-going comedy series (sitcoms) and category 7(d) Theatrical feature films aired on TV as set out in Item 6 of Schedule I of the Specialty Regulations, 1990, as amended from time to time.

The licensee's current nature of service condition of licence reads as follows:

4a) The licensee shall provide a national English-language Category 2 specialty television service devoted entirely to short form films shot on film, video or created with computer animation. Short TV will showcase Canadian and international cutting edge short form films, from 1 to 40 minutes in length.

The licensee proposes to replace the above ondition of licence with the following :

4a) The licensee shall provide a national English-language Category 2 specialty television service devoted to short form films shot on film, video or created with computer animation. BITE TV will showcase Canadian and international cutting edge short form films, from 1 to 40 minutes in length.

The licensee states that the amendments are consistent with Public Notice 2000-6, Public Notice 2008-100, and the Commission's policy of evaluating conditions of licence in light of a service's viability.

The licensee also states that the addition of categories 7(b) and 7(d) would enable BITE to better meet the needs and interests of Canadian audiences and short form film producers, and is substantially in the spirit of BITE's nature of service.

The licensee states that it would accept a further condition of licence whereby the proportion of programming that BITE could draw from category 7(d) would be limited to 15% of the broadcast day, measured during each six-month semester.

Application by RNC MEDIA Inc. to amend the broadcasting licence of the French-language commercial radio programming undertaking CJGO-FM La Sarre, Quebec in order to add an FM transmitter at Rouyn-Noranda, Quebec.

The licensee proposes to add an FM transmitter at Rouyn-Noranda to rebroadcast the programs of CJGO-FM so that it can adequately serve the population of Rouyn-Noranda. The licensee states that the transmitter is already operational and currently rebroadcasts the programming received by its station CHGO-FM Val d'Or. The licensee states that this change will allow it to accentuate the differences East and West Abitibi and thus better serve both areas.

The licensee states that no changes to the technical parameters of the transmitter at Rouyn-Noranda are proposed. Only the source of the programming of the transmitter will change.

Subject to approval of this above application, the licensee has also asked to amend the broadcasting licence of its French-language commercial radio programming undertaking CHGO-FM Val d'Or, Quebec by deleting its transmitter CHGO-FM-1 Rouyn-Noranda (2010-0001-0).

The intervention must be received by the Commission and by the applicant on or before the above-mentioned date. The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. The intervention will not be considered by the Commission and will not be part of the public file.

Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.

The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.

Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service of the notification was completed.

Submissions longer than five pages should include a summary.

Each paragraph of the submission should be numbered. In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.

Interventions should clearly identify the application referred to and indicate whether parties support or oppose the application, or, if they propose changes to it, include the facts and grounds for their proposal.
