CFCM-TV Québec – Licence amendment

  The Commission approves in part an application by TVA Group Inc. for a broadcasting licence to operate a transitional digital television programming undertaking associated with CFCM-TV Québec. Pursuant to Revised licensing framework for over-the-air digital television services, Broadcasting Regulatory Policy CRTC 2010-69, 10 February 2010, the Commission amends the broadcasting licence for the television programming undertaking CFCM-TV Québec in order to add a digital transmitter in Québec.
 

The application

The Commission received an application from TVA Group Inc. for a broadcasting licence to operate a transitional digital television (DTV) programming undertaking associated with CFCM-TV Québec. TVA Group Inc. proposed to simulcast the programming aired on CFCM-TV on the new digital station. The Commission did not receive any interventions in connection with this application.
 

Commission's analysis and determinations

In Revised licensing framework for over-the-air digital television services, Broadcasting Regulatory Policy CRTC 2010-69 , 10 February 2010 (Broadcasting Regulatory Policy 2010-69 ), the Commission announced that it would no longer issue separate broadcasting licences for DTV programming undertakings. Instead, the operation of DTV transmitters would be authorized by way of an amendment to the broadcasting licences of existing services, authorizing the simulcast, on a digital transmitter, of the programming broadcast by the associated station.

As TVA Group Inc. intends to simulcast the service's programming on the digital transmitter, the Commission is satisfied that this application is in conformity with all applicable terms and conditions set out in Broadcasting Regulatory Policy 2010-69 .

In light of the above, the Commission approves in part the application by TVA Group Inc. for a broadcasting licence to operate a transitional digital television undertaking. Pursuant to Broadcasting Regulatory Policy 2010-69 , the Commission amends the broadcasting licence for the television programming undertaking CFCM-TV Québec in order to add a digital transmitter in Québec.

The new transmitter will operate on channel 17 with an average effective radiated power (ERP) of 12,500 watts (maximum ERP of 21,200 watts with an effective height of antenna above average terrain of 117.1 metres).

The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, the licence amendment will not be in effect until the Department of Industry notifies the Commission that its technical requirements have been met and that a broadcasting certificate will be issued.

The transmitter must be operational at the earliest possible date and in any event no later than 31 August 2011, unless otherwise authorized by the Commission.

The Commission notes that the licensee intends to maintain all of the technical parameters of its new digital transmitter after the transition period, with the exception of the ERP, which it intends to increase. The licensee is encouraged to file the appropriate application as soon as possible.
