Application by Astral Media Radio inc. to renew the broadcasting licence for the French-language commercial FM radio programming undertaking CITF-FM Québec, expiring 31 August 2010.
The licensee proposes to delete the following conditions of licence:
- The licensee shall broadcast, in each broadcast week, a minimum of 63 hours of local programming and shall maintain the current level of 2 hours and 6 minutes of news.
- The licensee shall file, no later than 30 November of each broadcast year and until the expiry of the implementation period for the benefits related to Transfer of control of 3903206 Canada Inc., of Telemedia Radio Atlantic Inc. and of 50% of Radiomedia Inc. to Astral Radio Inc., Broadcasting Decision CRTC 2002-90, 19 April 2002, in a format approved by the Commission, a report on the diversity of musical selections aired on each of its three predominantly music-based FM network services (i.e., Énergie, RockDétente and Boom FM) for the previous year ending 31 August.
The licensee notes that no other broadcasting group is required by condition of licence to file a report on musical diversity or to broadcast, during each broadcast week, a level of local programming that exceeds what is required of all licensees under the Radio Regulations, 1986.

Application by 4352416 Canada Inc. to renew the broadcasting licence for the English-language specialty FM radio programming undertaking CJMB-FM Peterborough, expiring 31 August 2010.
It appears to the Commission that the licensee may have failed to comply with section 9(2) of the Radio Regulations, 1986 relating to filling of annual returns for the 2007 and 2008 broadcast years. It also appears to the Commission that the licensee may have failed to comply with its condition of licence relating to Canadian talent development contributions for the 2006 and 2008 broadcast years and for Canadian Content Development contributions for the 2009 broadcast year.
The licensee requests a change regarding Christmas music. Broadcasting Decision 2009-383 sets out the following condition of licence:
The licensee shall ensure that a minimum of 90% of all musical selections broadcast during each broadcast week shall be devoted to selections drawn from subcategory 35 (non-classic religious).
Since not all Christmas songs falls into subcategory 35, the licensee requests seasonal flexibility to broadcast a minimum level of 67% of Category 3 music and a maximum level of 33% Category 2 music each week during the Christmas season. The Commission notes that the licensee has identified the Christmas season as the period from 1 November until 5 January.

The intervention must be received by the Commission and by the applicant on or before the above-mentioned date.
The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. In such a case, the intervention will not be considered by the Commission and will not be part of the public file.
Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.
The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.
Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service of the notification was completed.
Submissions longer than five pages should include a summary.
Each paragraph of the submission should be numbered. In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.
Interventions should clearly identify the application referred to and indicate whether parties support or oppose the application, or, if they propose changes to it, include the facts and grounds for their proposal.
