Application by Rogers Broadcasting Limited to amend the broadcasting licences of its OMNI television programming undertakings CFMT-DT Toronto, CFMT-TV Toronto and its transmitters CFMT-TV-1 London and CFMT-TV-2 Ottawa, CJMT-DT Toronto, CJMT-TV Toronto and its transmitters CJMT-TV-1 London and CJMT-TV-2 Ottawa, CJCO-TV Calgary, CJEO-TV Edmonton, CHNM-DT Vancouver, and CHNM-TV Vancouver and its transmitter CHNM-TV Victoria.
Rogers wishes to take advantage of the additional flexibility provided by the Commission’s new Canadian content policy for conventional television stations announced in Broadcasting Regulatory Policy 2010-167.
The licensee proposes to replace the condition of licence relating to Canadian programs which reads:
The licensee shall devote to the broadcast of Canadian programs:
a) not less than 60% of the total number of hours broadcast annually between 6 a.m. and midnight;
b) not less than 50% of the total number of hours broadcast annually between 6 p.m. and midnight.
with the following condition:
Beginning with the 2010-2011 broadcast year, the licensee shall devote to the broadcast of Canadian programs:
a) not less than 55% of the total number of hours broadcast annually between 6 a.m. and midnight;
b) not less than 50% of the total number of hours broadcast annually between 6 p.m. and midnight.
Rogers states that approval of the proposed amendment will not impact the level of Canadian content broadcast during peak viewing hours. It will also have no impact on its broadcast of original Canadian programming, which is scheduled during those peak viewing hours. The additional flexibility provided by the overall 55% Canadian content requirement would affect only the broadcast of repeat Canadian programming. Thus, there would be no impact on its use of the ethnic production sector.
Rogers further states that the OMNI stations will continue to meet all other requirements of their licences, including all requirements relating to the broadcast of third-language programming and the provision of service to distinct ethnic groups.
Rogers proposes that the amendment take effect by 1 September 2010.

Application by Rogers Broadcasting Limited to amend the broadcasting licences of its Citytv television programming undertakings CITY-TV Toronto and its transmitters CITY-TV-2 Woodstock and CITY-TV-3 Ottawa, CITY-DT Toronto, CHMI-TV Portage la Prairie/Winnipeg, CKAL-TV Calgary and its transmitter CKAL-TV-1 Lethbridge, CKEM-TV Edmonton and its transmitter CKEM-TV-1 Red Deer, and CKVU-TV Vancouver and its transmitter CKVU-TV-1 Courtenay.
Rogers wishes to take advantage of the additional flexibility provided by the Commission’s new Canadian content policy for conventional television stations announced in Broadcasting Regulatory Policy 2010-167.
The licensee is requesting to be relieved of the 60% yearly Canadian programming requirement set out in section 4(6) of the Television Broadcasting Regulations, 1987. Instead, the licensee proposes the addition of the following condition of licence.
· As an exception to section 4(6) of the Television Broadcasting Regulations, 1987, the licensee shall devote not less than 55% of the broadcast year to the broadcasting of Canadian programs.
Rogers states that approval of the proposed amendment will not impact the level of Canadian content broadcast during peak viewing hours. The intervention must be received by the Commission and by the applicant on or before the above-mentioned date.
The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. In such a case, the intervention will not be considered by the Commission and will not be part of the public file.
Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.
The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.
Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service of the notification was completed.
Submissions longer than five pages should include a summary.
Each paragraph of the submission should be numbered. In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.
Interventions should clearly identify the application referred to and indicate whether parties support or oppose the application, or, if they propose changes to it, include the facts and grounds for their proposal.
