Application by Canwest Television GP Inc. (the general partner) and Canwest Media Inc. (the limited partner), carrying on business as Canwest Television Limited Partnership, to amend the broadcasting licence of the television programming undertaking CIII-TV-41 Toronto.

The new transmitter would operate on channel 41 with an average effective radiated power (ERP) of 100,000 watts (maximum ERP of 100,000 watts with an effective height of antenna above average terrain of 503 metres).

 The licensee states that the DTV regional service contour would be expanded to respect the obligation for the mandatory conversion to digital of the Barrie, Ontario market, where the analog signal is currently provided from Canwest’s Midland transmitter location. Furthermore, the licensee states that, even if it were to employ the maximum allowable ERP provided in the DTV Channel allotment, it would be impossible to cover Barrie with a DTV signal from the Midland location. The licensee also states that approving the power increase for the Toronto transmitter would allow coverage of the mandatory Barrie market.

Given that the Canwest transmitter serving Fort Erie on channel 55 must shut down effective 31 August 2011, the licensee would serve the Fort Erie market using the proposed transmitter.

These changes would lead to a decrease in the population in the local service area from 6,122,353 to 6,068,374 (-0.88%) and an increase in the regional service area from 6,811,922 to 7,437,819 (9.18%).

Application by Canwest Television GP Inc. (the general partner) and Canwest Media Inc. (the limited partner), carrying on business as Canwest Television Limited Partnership, to amend the broadcasting licence of the television programming undertaking CKND-TV Winnipeg.

The licensee is requesting to add a post-transitional digital transmitter to serve the Winnipeg area and to relocate its antenna.

The transmitter would operate on channel 40, which is a different channel than the one allotted in the Department of Industry's DTV Allotment Plan, with an average effective radiated power (ERP) of 14,900 watts (maximum ERP of 25,100 watts with an effective height of antenna above average terrain of 131.2 metres).

The licensee states that CKND-TV is currently transmitting from a leased tower site that is owned by the Canadian Broadcasting Corporation (CBC). The CBC tower is mechanically loaded to capacity, prohibiting the addition of another antenna. The licensee proposes to transmit from its own tower, located at Canwest Place. This change will result in a contour shift even though the proposed CKND-DT would transmit at its maximum allowable power. Accordingly, this change will result in a population decrease when compared to that of CKND’s current analog B contour.

These changes would lead to a decrease in the population in the local service area from 755,500 to 716,255 (-5.19 %) and a decrease in the regional service area from 855,721 to 774,626 (-9.47 %).

The licensee is applying for this amendment under the Commission’s new licensing framework for over-the-air digital television services as outlined in Broadcasting Regulatory Policy 2010-69.

The intervention must be received by the Commission and by the applicant on or before the above‑mentioned date.

The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. In such a case, the intervention will not be considered by the Commission and will not be part of the public file.

Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.

The Commission advises those who file and serve by electronic mode to exercise caution when using e‑mail for service of documents or notification, as it may be difficult to establish that service has occurred.

Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service of the notification was completed.

Submissions longer than five pages should include a summary.

Each paragraph of the submission should be numbered. In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.

Interventions should clearly identify the application referred to and indicate whether parties support or oppose the application, or, if they propose changes to it, include the facts and grounds for their proposal.
