Application by Videotron Ltd. (Videotron) to renew the broadcasting licence for its Class 1 terrestrial broadcasting distribution undertaking (BDU) serving Sherbrooke expiring 31 August 2010.

Videotron requests the addition of the following conditions of licence:

a)         The licensee is authorized to distribute, on a discretionary basis, a video games service as a special programming service, subject to the conditions listed in Licence amendments concerning the distribution of a video games service, Decision CRTC 95-591, 24 August 1995.

b)         The licensee is authorized to distribute, at its option, WCAX-TV (CBS) Burlington, WPTZ (NBC) Plattsburgh, WFFF-TV (FOX) Burlington and WCFE‑TV (PBS) Plattsburgh, as part of the basic service.

Videotron also requests amendments to and the deletion of certain conditions of licence. Further details are available in the application.

Videotron also requests a redefinition of its licensed service area.

In Broadcasting and Telecom Regulatory Policy 2009-430, the Commission stated its intention to impose on BDUs, at the time of their licence renewals, conditions of licence relating to described video. Furthermore, the Commission stated that it would consider imposing conditions of licence on BDUs relating to customer service if such requirements are necessary to achieve the Commission’s objectives. Additionally, conditions of licence relating to closed captioning and audio description could be applied to Videotron’s community channel to increase accessibility for persons with disabilities.

Application by Klondike Broadcasting Company Limited to amend the broadcasting licence for the English-language commercial radio programming undertaking CKRW Whitehorse.

The licensee proposes to add an FM rebroadcasting transmitter at Inuvik to broadcast the programming of CKRW in order to adequately serve the population of Inuvik.

The transmitter would operate on frequency 98.7 MHz (channel 254LP) with an effective radiated power of 43.68 watts (non-directional antenna with an effective height of antenna above average terrain of 30 metres).

The licensee states that the Inuvik rebroadcasting transmitter previously approved in Broadcasting Decision 2007-44 could not be implemented due to management turnover and extended negotiation for a binding agreement to lease the transmitter site.

Public participation

The intervention must be received by the Commission and by the applicant on or before the above‑mentioned date.

The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. In such a case, the intervention will not be considered by the Commission and will not be part of the public file.

Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.

The Commission advises those who file and serve by electronic mode to exercise caution when using e‑mail for service of documents or notification, as it may be difficult to establish that service has occurred.

Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service of the notification was completed.

Submissions longer than five pages should include a summary.

 Each paragraph of the submission should be numbered. In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.
