Direct-to-home pay-per-view service – Rescission of Broadcasting Decision CRTC 2010-112

1.      In Broadcasting Decision 2010-112, the Commission approved an application by Canyon.TV Incorporated (Canyon.TV), a corporation controlled by its sole shareholder and director, Mr. Warren Walsh, for a broadcasting licence to operate a national direct-to-home pay-per-view programming undertaking. As the applicant has not yet complied with the conditions of issuance of the licence by informing the Commission in writing that it is ready to commence operations, the Commission has yet to issue a licence to Canyon.TV pursuant to this approval.

2.      In Canyon.TV’s application, Mr. Walsh indicated that he is a Canadian within the meaning of the Direction to the CRTC (Ineligibility of non-Canadians) (the Direction). However, on 3 May 2010, Mr. Walsh submitted information indicating that this aspect of Canyon.TV’s application is incorrect and that Mr. Walsh is not a Canadian within the meaning of the Direction.

3.      The Commission notes that, pursuant to the Direction, it is not authorized to issue a broadcasting licence to a non-Canadian, as that term is used in the Direction. Consequently, the Commission hereby rescinds Broadcasting Decision 2010-112; it is no longer of any force or effect.

4.      The Commission notes that Canyon.TV may reapply for a broadcasting licence when it can establish that it is Canadian-owned and controlled.
