RE: Tariff Notices 153 and 154
On 25 November 2009 and 26 November 2009, the Commission received Tariff Notices 153 and 154, respectively, submitted by TBayTel. The company indicated that these applications were filed as Group B retail filings under Approval mechanisms for retail and CLEC tariffs, Telecom Decision 2008-74, 21 August 2008 (Telecom Decision 2008-74) as they proposed the introduction of new services.
Commission staff considers that, as the services in question pertain to Competitor Services, these applications do not meet the definition of Group B filings as outlined in Appendix 1 of Telecom Decision 2008-74. Accordingly, these applications will not be approved on an interim basis on the 15th calendar day after their receipt.
The Commission intends will dispose of these applications within 45 business days of receipt of the filings.
