Re: Telecom Notice of Consultation CRTC 2009-261, Proceeding to consider the appropriateness of mandating certain wholesale high-speed access services
The Commission is in receipt of a letter dated 30 October 2009, from MTS Allstream Inc. (MTS Allstream), requesting that the Commission modify the scope of the proceeding to permit the consideration of ADSL access service solutions other than a CO-based solution.
Commission staff notes that the arguments made to support MTS Allstream’s request are generally the same as those made in support of the company’s request for clarification regarding the scope of the above-captioned proceeding that was denied by the Commission in its letter of 23 October 2009. Accordingly, the Commission has already ruled on the merits of MTS Allstream’s request. Given this, no further action will be taken on this matter and the scope of the proceeding remains unchanged.
As noted in the Commission letter of 23 October 2009, the Commission’s ruling does not preclude future consideration of MTS Allstream’s proposals and related matters in light of, among other things, the disposition of various relevant petitions currently before the Governor-in-Council.
