RE: Registration as a Wireless Carrier by Globalive Wireless Management Corp.

The Commission is in receipt of a letter from Globalive Wireless Management Corp. (Globalive), operating as Wind Mobile, dated 2 November 2009 (a copy of which is enclosed) wherein Globalive alleges that a number of local exchange carriers have stopped cooperating with Globalive on various inter-carrier wireless activities since the release of Telecom Decision CRTC 2009-678 – Review of Globalive Wireless Management Corp. under the Canadian Ownership and Control Regime, 29 October 2009 (Telecom Decision 2009-678).  

Globalive requested that the Commission clarify that all local exchange carriers must continue to cooperate with Globalive in the manner that they did prior to the release of Telecom Decision 2009-678, unless and until the Commission revokes Globalive’s ‘Proposed Status’ as a wireless service provider, which was granted to Globalive in a Commission staff letter dated 18 November 2008 (a copy of which is enclosed).

Parties wishing to respond to Globalive’s complaint are to file their comments no later than 12:00 p.m. eastern standard time on 9 November 2009, serving copies on all other parties included in the distribution list below.  Globalive is to file its reply comments to the Commission no later than 5 p.m. eastern standard time on 11 November 2009, serving copies on all other parties included in the distribution list below. 

In their responses, parties are to comment on whether or not local exchange carriers must continue to cooperate with Globalive in the manner that they did prior to Telecom Decision 2009-678 whether as a result of existing tariffs (for example, tariffs for interconnection arrangements between wireless service providers), Commission staff’s 18 November 2009 letter, or otherwise.

All documents must be actually received, and not merely sent, by the dates and times indicated above.
