Re: Follow-up to Telecom Decision CRTC 2008-1, Use of deferral account funds to improve access to telecommunications services for persons with disabilities and to expand broadband services to rural and remote communities – Filing of follow-up information

Further to the Supreme Court of Canada Decision, dated 18 September 2009, dismissing appeals with respect to the Commission's determinations in Disposition of funds in the deferral accounts, Telecom Decision CRTC 2006-9, 16 February 2006 (Telecom Decision 2006-9), Commission staff hereby recommences certain follow-up filings and processes flowing from Use of deferral account funds to improve access to telecommunications services for persons with disabilities and to expand broadband services to rural and remote communities, Telecom Decision CRTC 2008-1, 17 January 2008 (Telecom Decision 2008-1).

In Telecom Decision 2008-1, as well as Telecom Public Notice CRTC 2006-15 – Use of deferral account funds to expand broadband services to certain rural and remote communities, Telecom Decision CRTC 2007-50, 6 July 2007, as amended by Telecom Decision CRTC 2007-50-1, 27 July 2007 (Telecom Decision 2007-50), the Commission approved the use of deferral account funds for initiatives to improve access to telecommunications services for persons with disabilities and for the expansion of broadband services to certain rural and remote communities.  The Commission also required that any remaining funds be rebated to the residential subscribers in non-high-cost serving areas (non-HCSAs) of record as of the release date of Telecom Decision 2008-1. 

As follow-up to Telecom Decisions 2007-50 and 2008-1, the Commission directed the involved incumbent local exchange carriers (ILECs), specifically Bell Canada, MTS Allstream Inc. (MTS Allstream) and TELUS Communications Company, as well as certain alternative broadband service providers (ABSPs) to file certain information pertaining to broadband expansion and rebates.

Commission staff, by letter dated 22 February 2008, deferred the filing of this information, pending final disposition of the appeals.

In light of the Supreme Court's decision referenced above, the implementation of Telecom Decisions 2007-50 and 2008-1 will proceed pursuant to the schedule identified below.

Approved Communities

 

The involved ILECs are to file

  • detailed plans rolling out broadband service to the approved communities by 31 December 2013 (including construction start date and service introduction date), revised cost studies, and estimated drawdowns for their approved broadband proposals;
  • revised cost studies in the same format used in the ILECs' broadband expansion proposals submitted in September and October 2007, including the Detailed Summary of Phase II Costs table; and
  • the estimated per community and total drawdowns from the deferral account.

Competitor Services

 

The involved ILECs are to file information pertaining to their proposed competitor services, including proposed tariffs for backbone access services available to ABSPs in the approved communities. Bell Canada and MTS Allstream are each to include supporting cost studies and proposals describing how an ABSP that has committed to providing broadband access in an approved community can use other services from the company to provide end-to-end connectivity, as directed in Telecom Decision 2008-1.

Consumer Rebates

The involved ILECs are to file proposals to rebate the funds remaining in their deferral accounts to their residential subscribers in non-HCSAs of record as of 17 January 2008.

Annual Report

The involved ILECs are to file a report that shall include

  • a description of their previous year's rollout, including the service introduction date for the communities in which broadband service was made available, and the supporting rationale for any changes to the previously filed plan;
  • an update to the relevant cost studies to show actual costs and any changes from the forecasted retail and competitor service revenues; and
  • any adjustment to the deferral account drawdown for the activities carried out in the previous year, and an update to the amount remaining in the ILEC's deferral account.

(RCI), previously filed responses to interrogatories pertaining to their late filed exclusion requests with respect to the DSAs in the 8 communities identified in Part I of Appendix A of Telecom Decision 2008-1.

With the exception of the annual reports, copies of parties' submissions must also be provided to the interested parties list identified in the distribution list accompanying this correspondence.

Commission staff also notes that, consistent with the Commission's determinations in Telecom Decision 2008-1 and TELUS Communications Company - Application to review and vary part of Telecom Decision 2008-1 related to the use of deferral account funds for broadband expansion, Telecom Decision CRTC 2008-102, 17 October 2008, requests from ILECs to provide broadband services using deferral account funds to any communities that were not approved in Telecom Decisions 2007-50 or 2008-1 will not be considered, except for the Bell supplemental  communities subject to further process as noted in Item 5 above.  Additionally, consistent with other Commission decisions in this respect, further exclusion requests from ABSPs to exempt any communities approved in Telecom Decisions 2007-50 or 2008-1 on the basis that the ABSP already provides service to the community or has firm plans to provide service to the community will similarly not be considered.
