Re:  MTS Allstream Part VII Application Requesting to Rescind Portions of Telecom Order CRTC 2009-484

The Commission is in receipt of an application, dated 18 September 2009, made by MTS Allstream Inc. (MTS Allstream) pursuant to Part VII of the CRTC Telecommunications Rules of Procedure requesting that the Commission review and rescind portions of Telecom Order CRTC 2009-484, Bell Aliant Regional Communications, Limited Partnership and Bell Canada – Applications to introduce usage-based billing and other changes to Gateway Access Services, 12 August 2009 (Order 2009-484).

The Commission is also in receipt of a Part VII application by TekSavvy Solutions Inc. (TSI), dated 11 September 2009, requesting that the Commission:  (1) review and vary Order 2009-484 by rescinding the interim approvals to usage-based billing made in that Order, and (2) stay Order 2009-484 pending Commission determination of TSI’s review and vary application. The process for TSI’s application was set out in Commission staff’s letter of 17 September 2009.

Given that TSI and MTS Allstream are each seeking similar relief in the form of rescissions, the two applications will be considered in one combined proceeding. Interested parties may file with the Commission, serving a copy on each of MTS Allstream and TSI, comments with respect to each application by 28 September 2009. MTS Allstream and TSI may provide file reply comments, serving a copy on all other parties, by 2 October 2009. These deadlines replace those set out in Commission staff’s letter of 17 September 2009.

Documents to be filed and served in accordance with the above process are to be received, not merely sent, by the dates indicated.
