Re: Globalive Witnesses at Public Hearing – Telecom Notice of Consultation 2009-429

Upon review of the witness list submitted to the Commission in respect of the above hearing, it is noted that Mr. N. Sawiris is not among those slated to attend.  

As the principle concern of the Commission in this hearing relates to Control in Fact, it is essential that the Commission has a complete understanding, as to the basis upon which Mr. Sawiris as the majority shareholder and lendor to Globalive, made the decision to make this investment and how he plans to manage it into the future.   

In this regard, it is the Commission's strong preference that Mr. Sawiris attend in person both days of the hearing; however it is understood that this is not possible.   Rather, Mr. Sawiris will be available by videoconference.

After due consideration of the issues that the Commission would like to discuss with Mr. Sawiris, it has been identified that the issues relate to areas over which confidentiality has not been sought and properly form part of the public record.   However it may be the case that there will be a need to discuss some issues that have been designated as confidential.

As a result the videoconference bridge should be established and Mr. Sawiris should be available between xx and xx Gatineau time on Wednesday, September 23, 2009 and xx and xx Gatineau time on Thursday, September 24, 2009.

It should also be noted that the Commission's videoconference facilities run over the TELUS' network and that the Commission cannot provide a secure private network connection internationally.
