Subject: Call for comments - Review of the large incumbent local exchange carriers’ support structure service rates, Telecom Notice of Consultation CRTC 2009-432, 21 July 2009 – Requests from cable carriers
Dear Madams and Sirs:
In a letter to the Commission dated 2 September 2009 Bragg Communications Inc., the Canadian Cable Systems Alliance, Cogeco Cable Inc., Rogers Communications Inc., Shaw Communications Inc. and Quebecor Media Inc., on behalf of its affiliate Videotron Ltd. (collectively, the cable carriers) requested, for the reasons set out in that letter, that certain interrogatory responses considered in the proceeding initiated by Call for comments - Review of the large incumbent local exchange carriers’ support structure service rates, Telecom Notice of Consultation CRTC 2009-432, 21 July 2009 (the notice) be disclosed. In that letter and, in particular in paragraph 42, the cable carriers requested that:
- certain responses from Bell Aliant Regional Communications, Limited Partnership (Bell Aliant), Bell Canada, MTS Allstream, Télébec, Limited Partnership (Télébec), and TELUS Communications Company (TCC) (collectively, the ILECs) be removed from the record and the ILECs be required to file, without any claim for confidentiality, cost studies for pole, strand and conduit throughout their incumbent serving areas, in accordance with the methodology in Access to Telephone Company Support Structures, Telecom Decision CRTC 95-13, 22 June 1995 (Decision 95-13) and the template in Attachment A to the cable carriers’ letter (the letter); or in the alternative;
- the information identified in Table 2 of the letter be removed from the record of this proceeding and the ILECs be directed to file, without any claim for confidentiality, the missing costing information shown in Table 3 of the letter; and,
- where it is not possible to provide the necessary costing information, the current support structure rates remain in place, as there is no basis for altering these rates.
The cable carriers also filed an application on 11 September 2009, seeking a ruling from the Commission to direct the ILECs to disclose on the public record their historical and current estimates for each of the cost elements and allocation factors identified in the pricing methodology adopted in Decision 95-13, as shown in Attachment A to their application, that have been or are filed in the course of this proceeding.
The ILECs and other parties may file comments on both cable carriers’ submissions by 21 September 2009 and the cable carriers may file comments in reply by 28 September 2009.
The above material must be received, not merely sent, by this date. All submissions must be served on all other parties by the dates provided herein.
Further, procedural dates in the notice will be revised once the above-noted applications have been addressed.
