Re: Telecom Order CRTC 2009-484 - Bell Aliant Tariff Notice 242 and Bell Canada Tariff Notice 7181


1.  Request to extend Telecom Order CRTC 2009-484 implementation date

 

In Tariff Notice (TN) 242 and TN 7181, Bell Aliant Regional Communications, Limited Partnership Tariff Notice and Bell Canada (the Bell companies) proposed changes to their Gateway Access Service (GAS) in Ontario and Quebec. In Telecom Order CRTC 2009-484, the Commission approved on an interim basis the Bell companies’ proposed two new GAS speed options and rates, their proposal to introduce usage-based billing (UBB) for GAS, effective 90 days from the date of the order, and their proposal to introduce an excessive usage charge for GAS, effective the date the Bell companies notify the Commission that they apply an excessive usage charge to all their retail customers on UBB plans.


In an application to the Commission dated 20 August 2009, Vaxination Informatique (Vaxination) requested, for the reasons set out in that application, an extension of the time approved in Telecom Order CRTC 2009-484 for implementation of that order.

Parties may file comments on Vaxination’s application by 22 September 2009. Vaxination
may file comments in reply by 1 October 2009. Assumes letter issued on Tuesday.


2. Request to extend interrogatory response date


By letter dated 27 August 2009, the Bell companies requested an extension of time to respond to interrogatories addressed to them in a Commission staff letter dated 20 August 2009 (the 20 August 2009 letter). Specifically, the Companies requested an extension from 11 September 2009 to 5 October 2009 in light of what the nature of the questions and costing requirements associated with other proceedings. Commission staff considers the Companies request is reasonable in the circumstances.


The date specified for Reponses to interrogatories in the 20 August 2009 letter is therefore changed to 5 October 2009.


Consistent with this change, the remaining process dates established in the 20 August 2009 letter are changed as follows:

               Replies for requests for public disclosure               23 October 2009


               Service of information, if any to be provided

               pursuant to determination with respect to

               requests for public disclosure                              3 November 2009

As noted in the 20 August 2009 letter, the comments and reply comments identified above are restricted to the Companies’ economic evaluation report of 16 July 2009 and their responses to the interrogatories.


3. Service


A copy of each interrogatory response, comment or other submission filed in accordance with the processes set out above must be served on all other parties by the applicable filing date. When a document is to be filed or served by a specific date, the document must actually be received, not sent, by that date.
