Re: Bell Canada Part VII Application Seeking Forbearance of Bell Canada's High-Speed Intra-Exchange Digital Network Access Services Pursuant to Telecom Decision CRTC 2007-35
On 26 June 2009, Bell Canada filed a Part VII Application seeking forbearance of Bell Canada 's high-speed intra-exchange digital network access (high-speed DNA) pursuant to Telecom Decision CRTC 2007-35 in 35 wire centers in Ontario and Quebec. A copy of the application can be found on the Commission's website ( click here ).
Pursuant to Bell Canada 's application, competitors listed in Bell Canada's application were to file in confidence with the Commission, by 27 July 2009, a list of all buildings connected to their high-speed DNA capable network that are located in 35 wire centers in Ontario and Quebec as identified by Bell Canada in its application.
On 24 July 2009, the deadline to provide the data required was extended to 4 August 2009.
To this date Verizon Canada Ltd. has not provided the Commission with the required information. Therefore, Verizon Canada Ltd. is requested to file in confidence with the Commission, as soon as possible but no later than 26 August 2009, a list of all buildings connected to its high-speed DNA capable network that are located in the wire centers identified by Bell Canada in its application in the format set out in Appendix 1 of Telecom Decision 2007-35 or file a letter attesting that Verizon Canada Ltd. has no such facilities in the wire centers identified by Bell Canada. The failure to present the requested data may result in an adverse inference to be drawn by the Commission.
Where a document is to be filed by a specific date, the document must be actually received, and not merely sent, by that date.
