Subject: Submission regarding Telecom Notice of Consultation CRTC 2009-432
By letter dated 27 July 2009, Bragg Communications Inc., the Canadian Cable Systems Alliance, Cogeco Cable Inc., Rogers Communications Inc., Shaw Communications Inc., and Quebecor Media Inc., on behalf of its affiliate Videotron Ltd (collectively, the cable carriers) requested modification of the procedures established in Telecom Notice of Consultation CRTC 2009-432, Call for comments – Review of the large incumbent local exchange carriers' support structure service rates, 21 July 2009 (the Notice).
Specifically, the cable carriers requested that, prior to the interrogatory phase of the associated proceeding, the incumbent local exchange carriers (ILECs) involved in the proceeding established by the Notice be required to disclose information in their cost studies and interrogatory responses for which they claimed confidentiality. The cable carriers also requested consequential adjustments to the dates established by the Notice for the other procedural steps.
Commission staff notes that the ILECs and companies, including the cable carriers that commented on the application leading to the Notice, were made party to this proceeding in paragraph 31 of the Notice, and that other parties have subsequently registered pursuant to paragraph 32 of the Notice (parties).
Parties may, by 10 August 2009, file comments with the Commission and serve a copy on the cable carriers, in response to the cable carriers' requests for disclosure of information for which the ILECs have claimed confidentiality and for consequential procedural changes.
The cable carriers may, by 12 August 2009 file a reply with the Commission and serve a copy on all other parties.
Submissions must be served on all other parties and actually received, not merely sent, by that date.
In view of the cable carriers' request and the process established in this letter, the 11 August 2009 date for addressing interrogatories to the ILECs is suspended.
