Subject:  Tariff Notice 130 – Housekeeping – Terms of Service

On 18 June 2009, the Commission received the above-mentioned tariff notice submitted by Bruce Telecom. The company indicated that its application was filed as a Group A filing under Approval mechanisms for retail and CLEC tariffs, Telecom Decision 2008-74, 21 August 2008 (Decision 2008-74).

Commission staff considers that application does not meet the definition of a Group A filing under Decision 2008-74. In particular, the modification to Item 12.01 – Directories is a change “to the terms and/or conditions of a tariff” and, therefore, falls under Group B.

Staff also notes that the company has deleted Item 6.01 – Two-Party – Grandfathered Service from its General Tariff. Staff requests that the company submit a new cover letter to this application requesting that Item 6.01 be withdrawn. The cover letter should provide the information outlined in the appendix to Mandatory customer contract renewal notification and requirements for service destandardization/withdrawal, Telecom Decision 2008-22, 6 March 2008. Furthermore, the word “Delete” on page 2 of Section 80 of the company’s General Tariff should be replaced with “Reserved for future use.”

The company is asked to file these revisions by 3 July 2009. The Commission will then process the application as a Group B application. In the meantime, the company is not to implement the revisions proposed in Tariff Notice 130.
