Re: Part VII applications for forbearance from the regulation of residential and business local exchange services in Thunder Bay, Ontario

On 15 August 2008 and 8 April 2009, the Commission received the above-mentioned Part VII applications by TBayTel, pursuant to Telecom Decision 2006-15 as amended by the Governor in Council’s Order varying Telecom Decision CRTC 2006-15, PC 2007-532, 4 April 2007 (modified Telecom Decision 2006-15).

Since modified Telecom Decision 2006-15 established a local forbearance framework applicable to incumbent local exchange carriers (ILEC) and not to small incumbent local exchange carriers (SILEC), the Commission issued Telecom Public Notice CRTC 2008-18, Call for comments on whether the regulatory framework for forbearance from the regulation of local exchange services for the large incumbent local exchange carriers should also be applicable to small incumbent local exchange carriers.  This process led to Telecom Decision 2009-379 published today.

In order to assess TBayTel’s above-mentioned applications, Commission staff requests TBayTel to update these two applications in order to meet all the requirements set-out in Telecom Decision 2009-379 by 6 July 2009.  Interested parties will have until 13 July 2009 to file comments on TBayTel’s amended submission and TBayTel will have until 17 July 2009 to file reply comments.

Where a document is to be filed by a specific date, the document must be actually received, and not merely sent, by that date.
