RE:  NorthernTel Limited Partnership’s request to recover the net incremental operating costs to implement an expanded local calling area between Black RiverMatheson and Ramore

Dear Madam or Sir:

On 16 December 2008, the Commission received an application by NorthernTel Limited Partnership (NorthernTel) pursuant to Part VII of the CRTC Rules of Procedure, in which the company proposed the introduction of an expanded local calling area (LCA) between Black River Matheson and Ramore. The submission requested approval of both the forgone toll surcharge as well as an exogenous adjustment to permit the company to recover the net incremental operating costs associated with the implementation of the expanded LCA.

Subsequently, the Commission received NorthernTel Tariff Notice 269, dated 26 February 2009, proposing tariff amendments for only the forgone toll surcharge associated with the introduction of the expanded LCA. In its application, the company stated that, following the approval of the tariff notice, it would file an amended Part VII application seeking approval for the recovery of the net incremental operating costs via an exogenous adjustment.

Commission staff notes that NorthernTel’s tariff proposal was approved on 30 March 2009 and to date the company has not filed its amended Part VII application as indicated in its 26 February 2009 application.

Given the elapsed time, Commission staff is closing the original Part VII application. The Commission is willing to consider a new Part VII application from NorthernTel to address the recovery of the net incremental operating costs.
