Re: Telecom Notice of Consultation CRTC 2009-261, Proceeding to consider the appropriateness of mandating certain wholesale high-speed access services
Dear Mr. Hersche:
The Commission is in receipt of a letter, dated 14 May 2009, from SaskTel requesting that the Commission amend the list of parties made party to this proceeding to include any cable carriers who are identified by other parties as significant regional service providers, and specifically to include Access Communications Co-operative Limited (Access).
Given that this proceeding involves the application of the existing wholesale regulatory framework set out in Telecom Decision 2008-17 (the existing framework), the determinations stemming from the proceeding will apply only to those parties that are subject to the existing framework.
Given that Access is not subject to the regulatory framework set out in Decision 2008-17, it will not be subject to the determinations arising from this proceeding.
Accordingly, the Commission denies SaskTel’s request.
The Commission notes that it may review the applicability of its findings to other parties at the conclusion of the proceeding.
