RE: Tariff Notice 150 – Introduction of 5-1-1 Service

 

On 4 May 2009, t he Commission received the above-mentioned tariff notice submitted by TBayTel. The company indicated that its application was filed as a Group A filing under Approval mechanisms for retail and CLEC tariffs, Telecom Decision 2008-74, 21 August 2008 (Decision 2008-74).

Commission staff considers that the application does not meet the definition of Group A filings as indicated in Appendix 1 of Decision 2008-74.   In particular, as the company has proposed the introduction of a new service, it does not meet part (a) of the definitions of Group A filings in that it is not “changes to previously approved rates for retail services where the revised rates meet the Commission's price cap or price regulation rules, and the imputation test as applicable” [emphasis added].

 

For purposes of efficiency, the Commission will process this application as a Group B filing rather than close the file and require the company to refile it as a new application.   The company is to file revised tariff pages with an effective date no earlier than 19 May 2009, which is 15 days from the date its application was received.   At the same time, the company is not to implement these tariff revisions until then.
