Re:  Review of the Small ILEC Regulatory Framework

 

The small incumbent local exchange carriers (ILECs) currently operate under a regulatory framework established by the Commission in Revised regulatory framework for the small incumbent local exchange carriers, Telecom Decision CRTC 2006-14, 29 March 2006.   That framework is set to expire on 31 December 2009.

 

On 1 May 2009, the Commission received a letter from the Canadian Independent Telephone Company – Joint Task Force (CITC-JTF) representing the member companies of the Association des compagnies de téléphone du Québec, the Canadian Alliance of Publicly-owned Telecommunications Systems, the Ontario Telecommunications Association, the Société d'administration des tarifs d'accès de télécommunicateurs, and TBayTel.

 

In its letter, the CITC-JTF requested that the Commission delay the launch of the upcoming review of the regulatory framework for the small ILECs in order to accommodate a period of 45 days beginning 1 May 2009, during which time the CITC-JTF would conduct a series of meetings with Bell Canada to discuss certain key components of the small ILEC framework.   The CITC-JTF stated that it anticipated developing a proposal for submission to the Commission in which certain key components would be endorsed by both parties.  

 

On 1 May 2009 the Commission received a letter from Bell Aliant Regional Communications, Limited Partnership, Bell Canada , KMTS, and NorthernTel Limited Partnership in support of the CITC-JTF's request.

 

Commission staff considers that the request for a delay of the launch of the Commission's upcoming review of the regulatory framework for the small ILECs is reasonable.   Commission staff encourages the parties to work cooperatively to resolve issues in advance of the Commission's review.
