Re: Cybersurf application for relief against Bell Canada regarding certain billing practices and disconnection
On 2 April 2009, Commission staff sent out a final series of interrogatories to both Bell Canada ( Bell ) and Cybersurf in relation to the Part VII application filed by Cybersurf on 26 November 2008 regarding certain billing practices and disconnection by Bell.
Interrogatories with respect to a sample set of subscribers
On 14 April 2009, Commission staff received Bell 's response to the following interrogatories, Bell(CRTC)02Apr09-6 and Bell(CRTC)02Apr09-7. These interrogatories sought to identify, based on a sample of Cybersurf's subscriber accounts, the lapse of time between a request communicated by Cybersurf to Bell to terminate a particular subscriber and the actual date that Bell would have proceeded with the disconnection.
After reviewing the response submitted by Bell to these interrogatories, staff considers that the sample of subscriber accounts provided to Bell was not suitable to gather the information required.
As a result, Commission staff is issuing a revised version of these interrogatories with a more suitable sample of subscriber accounts for Bell 's review and response. This information will allow the Commission to make its determination based on a more complete and representative set of data.
These revised interrogatories are set out in Attachment 1 to this letter. Commission staff has also revised the timelines in relation to the Part VII application as set out below.
Revised Process
1) Bell Canada is to file its response to interrogatories in Attachment 1 with the Commission, serving a copy on Cybersurf, by 06 May 2009;
2) Cybersurf is to file any comments with reference to Bell Canada 's response to item 1) with the Commission, serving a copy on Cybersurf, by 09 May 2009;
4) Bell Canada may file final comments (on all submissions with regard to this proceeding), with the Commission, serving a copy on Cybersurf, by 27 May 2009;
5) Cybersurf may file final reply comments (on all submissions with regard to this proceeding), with the Commission, serving a copy on Bell Canada, by 4 June 2009.
