RE: Bell Aliant Tariff Notice 245 and Bell Canada Tariff Notice 7185

On 25 March 2009, the Commission received applications by Bell Aliant Regional Communications, Limited Partnership and Bell Canada (the companies), in which they proposed revisions to, among other things, their respective General Tariff item 70, Rate Schedules for Primary Exchange (Local) Service, in order to increase certain rates for residential primary exchange service (PES) in Ontario and Québec.

In addition, the companies proposed to remove certain rate bands for which all the exchanges in these rates bands were forborne from the regulation of residential local exchange services.

In their applications, the companies indicated and certified that the Tariff Notices were Group A filings, as defined in Approval mechanisms for retail and CLEC tariffs, Telecom Decision 2008-74, 21 August 2008 (Decision 2008-74). The companies also proposed an effective date of 1 June 2009 for their proposed changes.

As identified by letter to TELUS Communications Company, dated 26 February 2009, Commission staff notes that removal of a rate band is not included in the criteria for Group A filings indicated in Decision 2008-74. These applications are therefore incorrectly identified as group A filings.

Rather than requiring re-submission of these applications, for reasons of efficiency, these applications will be treated as Group B filings.

However, interim approval is not to take effect on the 15 th calendar day after receipt of these applications. The Commission intends to dispose of these applications within 45 business days of receipt of the applications.
