RE: Bell Aliant Tariff Notice 244 and Bell Canada Tariff Notice7184
On 25 March 2009, the Commission received applications by Bell Aliant Regional Communications, Limited Partnership and Bell Canada (the companies), in which the companies proposed revisions to their respective General Tariff item 70, Rate Schedules for Primary Exchange (Local) Service, in order to increase certain rates for individual business lines.
In the applications, the companies indicated and certified that the Tariff Notices were Group A filings, as defined in Approval mechanisms for retail and CLEC tariffs, Telecom Decision 2008-74, 21 August 2008 (Decision 2008-74). In addition, the companies proposed an effective date of 1 June 2009.
Commission staff notes that in Part VII application by Canada Payphone Corporation and FCT Communications Inc. regarding incumbent local exchange carrier tariffs for payphone access lines , Telecom Decision CRTC 2006-56, 8 September 2006, the Commission considered that if individual rates for business local exchange service were increased or decreased, these rate changes would flow through to the payphone access line service rates.
Commission staff notes that, in the proposed revision to page 51-1B, while certain rates for individual business lines (business local exchange service) were increased, the rates for Pay Telephone Basic Access Line Service were unchanged. These applications do not meet the Commission's pricing rule for payphone access lines and are therefore incorrectly identified as group A filings.
In light of the above, these applications are closed. The companies are invited to resubmit their applications with appropriate changes at their earliest convenience.
