Re:  Request for enforcement of Telecom Decision CRTC 2008-117 and Telecom Order CRTC 2009-111 and Bell and TELUS stay applications

 

By letter dated 24 March 2009, the Canadian Association of Internet Providers (CAIP), Cybersurf Corp., Distributel Communications Limited (Distributel) and Yak Communications (Canada) Corp. (collectively, CAIP et al.) requested that the Commission enforce Telecom Decision CRTC 2008-117 and Telecom Order CRTC 2009-111 (the Decisions ).  By separate letter dated 24 March 2009, Execulink Telecom Inc. supported CAIP et al.'s position.

 

The Decisions are the subject of separate petitions to the Governor in Council made by Bell Aliant Regional Communications, Limited Partnership and Bell Canada (together, Bell) and TELUS Communications Company (TELUS) on 11 March 2009 and 12 March 2009, respectively.

 

Bell and TELUS also applied to the Commission on 11 March 2009 and 12 March 2009, respectively, requesting that it stay the implementation of the Decisions pending the resolution of their petitions to the Governor in Council (stay applications).

 

By letter dated 16 March 2009, Commission staff set out process for the stay applications. It is noted that in the proceeding to consider the stay applications, Distributel submitted that it would be appropriate for the Commission to register the Decisions and its decision on the stay application with the Federal Court. In the circumstances, the 24 March 2009 submissions of CAIP et al. and Execulink will form part of the stay application record.

 

A decision on the stay applications will be issued as soon as possible after the close of record date of 6 April 2009.
