RE: Tariff Notice 47 – 9-1-1 Public Emergency Reporting Service

 

On 18 March 2009, the Commission received the above-mentioned tariff notice submitted by KMTS. The company indicated that its application was a Group A filing in accordance with Approval mechanisms for retail and CLEC tariffs, Telecom Decision 2008-74, 21 August 2008 (Decision 2008-74).

Commission staff considers that application does not meet the definition of Group A filings as indicated in Appendix 1 of Decision 2008-74. In particular, it does not meet part (a) of the definition for Group A filings - ”changes to previously approved rates for retail services where the revised rates meet the Commission’s price cap or price regulation rules, and the imputation test as applicable”.

 

For purposes of efficiency, the Commission will process this application as a Group B filing, rather than close the file and require the company to refile it as a new application.

 

Commission staff has asked the company for further information with respect to this application.  Consequently, this application will not be approved on an interim basis on the 15th calendar day after it was received.
