RE: Tariff Notice 9 – Revisions to the Competitive Local Exchange Carrier Tariff

 

On 28 February 2009, the Commission received an application by ISP Telecom Inc. (ISP Telecom), under cover of Tariff Notice (TN) 9, in which the company proposed modifications to its Competitive Local Exchange Carrier (CLEC) Tariff. Commission staff notes that this is a Group B filing to: (i) remove rates for interconnection services in British Columbia, and (ii) add rates for interconnection services applicable in the incumbent operating territory of TBayTel.

 

Commission staff notes that these changes do not appear to be consistent with previous information provided by the company with respect to its serving areas and that the application did not provide an explanation as to why these changes are appropriate.

 

Commission staff further notes that CLECs are required to meet the CLEC obligations set out in Local Competition, Telecom Decision CRTC 97-8, 1 May 2007, as modified from time to time.  An overview of these requirements can be found on the Commission’s website at the following link: http://www.crtc.gc.ca/eng/comm/telecom/eslcclec.htm

 

The company is asked to clarify by 31 March 2009 whether it is proposing to change its existing service areas and, if so, to indicate when it will fulfill the CLEC obligations related to such changes.

 

Consequently, this application will not be approved on a final basis on the 32nd calendar day after it was received.  The Commission intends to dispose of this application prior to the end of April 2009.
