Re:  TCC Tariff Notice 346

 

The Commission received an application (Tariff Notice 346) from TELUS Communications Company (TCC), dated 17 February 2009, proposing to withdraw Carrier Access Tariff (CRTC 21462) Item 214, Asymmetric Subscriber Line (ADSL) Access Service.

 

The Commission also received a letter, dated 27 February 2009, from The Internet Centre Inc. opposing the immediate withdrawal of the TCC's Carrier Access Tariff Item 214, as proposed by TCC. In response, on 9 March 2009, TCC submitted that the Commission should continue with its process for approval of its application, stating that the Internet Centre has provided no basis for the Commission to suspend its determination.

 

Commission staff notes that there is currently a follow-up proceeding underway related to the above service that was initiated as a result of requests to review and vary directives in Telecom Decision 2008-17 related to the provision of central-office-based wholesale ADSL access service and aggregated ADSL access service, Telecom Regulatory Policy CRTC 2009-34, 26 January 2009.

 

Accordingly, the Commission staff is unable to dispose of this application within 45 business days of the filing date. The Commission staff expects the

 

Commission to render a decision with respect to the above-noted application only after the Commission issues its decision on the follow-up proceeding identified above.
