RE : Tariff Notice 506 – Wireless service provider enhanced 9-1-1 service

 

Mr. Romaniuk,

 

On 25 February 2009, the Commission received the above-mentioned tariff notice submitted by TELUS Communications Company (TCC) in which TCC proposed the introduction of item 2.30 – Service 9-1-1 Évolué – Fournisseurs de service sans fil (FSSF) to its General Tariff for its serving territory in Québec.

 

TCC submitted that its application was filed as a Group B tariff filing consistent with Approval mechanisms for retail and CLEC tariffs , Telecom Decision 2008-74, 21 August 2008 (Decision 2008-74).

 

Commission staff considers that this application is not subject to the regulatory policy adopted by the Commission in Decision 2008-74 since the service in question is not a retail telecommunication service, but rather a service offered to competitors.

 

For purposes of efficiency, the Commission will process this application as a Competitor Tariff Notice rather than close the file and require TCC to refile it as a new application.   Therefore, TCC is not to implement the tariff revisions proposed in its application before the Commission issues an order or a decision in this regard.

 

Furthermore, Commission staff notes that TCC's application raises significant issues related to the mark-up included in the rate for the proposed service.   The Commission expects to render its decision by the end of April 2009.
