Dear Mr. Mercier,
Re: Télébec Tariff Notice 381 – Ethernet Service
On 30 January 2009, the Commission received an application by Télébec, Société en commandite (Télébec) under cover of Tariff Notice 381 (TN 381) proposing to amalgamate the various elements of the Ethernet service into a single offering under a single tariff item.
On 20 February 2009, the Commission received a letter from TELUS Communications Company (TCC) requesting that the deadline for filing comments by interested parties be extended to 16 March 2009. In support of its request, TCC indicated that it had not completed its analysis of Télébec’s proposed amendments and their impact on TCC operations. Noting that Télébec had specified that no competing undertaking was currently using the services in question, TCC argued that its request for an extension was in no way prejudicial to Télébec.
On 26 February 2009, the Commission received a letter from Télébec asking the Commission to stay its examination of TN 381. Télébec indicated that it was currently reviewing the economic study it had filed in support of its application, that it expected to complete the review by the end of April 2009, and that it would advise the Commission of any resulting impact on the rates proposed in TN 381. On the same date, the Commission received a letter from TCC indicating that it did not oppose Télébec’s request to stay examination of TN 381.
In light of the foregoing, the request by Télébec to stay examination of TN 381 is approved. Télébec is required to inform the Commission and TCC of its intentions concerning TN 381, by the end of April 2009.
Sincerely,
