RE:  TCC Tariff Notice 345, TCBC Tariff Notice 4316 and former TCI Tariff Notice 614

 

On 17 February 2009, the Commission received applications by TELUS Communications Company (TCC), filed under cover of Tariff Notices 345, 4316 and 614, in which the company proposed revisions to General Tariff Item 317, Residence One Feature or Call Display Plus Bundle, TCBC General Tariff item 32, Exchange Rates and former TCI General Tariff item 425, Exchange Service.

 

In its applications, TCC indicated and certified that the Tariff Notices were Group A filings, as defined in Approval mechanisms for retail and CLEC tariffs, Telecom Decision 2008-74, 21 August 2008. In addition TCC, proposed an effective date of 18 February 2009.

 

Commission staff notes the following concerns with respect to the applications. 

 

1) In the cover letter, TCC stated that the tariff notice involves removing all remaining reference to Rate Band A for both Alberta and British Columbia (in light of the fact that all exchanges in this rate band have been forborne by the Commission).  The indicated changes have not been reflected in the issued tariff pages.

2) The are a number of changes that have not been identified in the cover letter:

(a) in Item 32, the  introduction of a condition, namely, note 5, which indicates that Message Relay charges apply;

(b) in Item 317, rate changes to the minimum rates for Rate Bands B to D in Alberta and Rate Bands B to G in British Columbia for all three bundles; and 

(c) in Item 425, rate changes to the maximum rate for Rate Band B2 and the current rate for Rate Band for E1.  

Commission staff notes that such changes as identified in 1) are not considered to be updates to tariff pages to incorporate forborne exchanges or routes and 2(a) results in changes to the terms and/or conditions of a tariff.  Accordingly, these changes do not comply with the definition of group A filings and do not meet the filing requirements for group A filings for retail tariffs.

 

The changes identified in 2(b) and 2(c) would comply with group A filings.  However, since these changes were not identified in the cover letter, Commission staff is concerned that certain changes may reflect errors.

 

Since certain elements of these applications are not Group A filings, they are not forborne from approval and the proposed changes would not have come into effect on 18 February 2009.

 

In light of the above, these files are closed and TCC is invited to resubmit its applications with appropriate changes at its earliest convenience.
