RE: Tariff Notice 6 – Revisions to the Competitive Local Exchange Carrier Tariff
On 13 February 2009, t he Commission received the above-mentioned tariff notice submitted by Sogetel Numérique. The company indicated that its application was filed as a Group A filing under Approval mechanisms for retail and CLEC tariffs, Telecom Decision 2008-74, 21 August 2008 (Decision 2008-74).
Commission staff considers that this application does not meet the definition of Group A filings as indicated in Appendix 1 of Decision 2008-74. In particular, it does not meet part (b) of the definitions of Group A filings in that it is not “a housekeeping change to an existing tariff for retail services ” [emphasis added]. Commission staff notes that, as stated in paragraph 3 of the Appendix 1 to Decision 2008-74, all CLEC tariff filings are to be filed as Group B filings.
For purposes of efficiency, the Commission will process this application as a Group B filing rather than close the file and require the company to refile it as a new application. The company is to issue revised tariff pages with an effective date no earlier than 28 February 2009, which is 15 days from the date its application was received. At the same time, the company is not to implement these tariff revisions until then.
