RE: TCC Tariff Notice 344, TCBC Tariff Notice 4314 and Former TC Tariff Notice 611

 

On 28 January 2009, the Commission received applications by TELUS Communications Company (TCC), filed under cover of Tariff Notices 344, 4313 and 611, in which the company proposed revisions to General Tariff Item 317, Residence One Feature or Call Display Plus Bundle, TCBC General Tariff item 32, Exchange Rates and former TCI General Tariff item 425, Exchange Service.

 

In its applications TCC indicated and certified that the Tariff Notices were Group A filings, as defined in Approval mechanisms for retail and CLEC tariffs, Telecom Decision 2008-74, 21 August 2008. In addition TCC, proposed an effective date of 28 January 2009, co-incident with these filings.

 

Commission staff notes that in the revised page 329A, TCC has removed sub-bands A3, and B4 and has not provided for a maximum rate for sub-band B2. Commission staff notes that approval of these changes would result in policy revisions with regards to the publicly specified rate. These applications are therefore incorrectly identified as group A filings and do not meet the filing requirements for retail tariffs.

 

Since these applications are not Group A filings, they are not forborne from approval and the proposed changes would not have come into effect on 28 January 2009.  In addition, these files are closed and TCC is invited to resubmit its applications with appropriate changes at its earliest convenience.
