Dear Mr. Walden:

Re: Applications by Kincardine for local competition in Bruce Telecom and
       HuronTel territories

In letters dated 11 and 17 October 2007, Kincardine Cable TV Ltd. (Kincardine) made a formal expression of its interest in using competitor services in the incumbent territories of Bruce Telecom (Bruce) and Huron Telecommunications Co-operative Ltd. (HuronTel).

Bruce and HuronTel both stated in their reply letters, dated 25 November 2008, that they would not consider Kincardine’s applications to be bona fide until Kincardine had obtained proposed CLEC status.  On 5 December 2008, Commission staff sent a letter to Kincardine indicating the steps it needed to take in order to obtain proposed CLEC status.  This information, which can be found on the Commission’s website, had also been sent to Kincardine in an email dated 23 July 2008.

As Kincardine has not yet registered as a proposed CLEC, despite the long period of time that has passed since its applications, Commission staff will now close these files. Any further attempt by Kincardine to enter these territories will require a new formal expression of its interest to the companies.

Yours sincerely,

Paul Godin
